			<content:encoded><![CDATA[<p>I understand that hiring an attorney, like me, is too expensive for most people, so I do offer paralegal services. I have properly trained my certified paralegal so I know she does accurate work, and because, I do not go to court when my office performs paralegal services, I can pass on that savings to the client.</p>
<p>Divorces: My firm offers more than just drafting documents when it comes to filing your divorce.</p>
<p>First, I meet with the client to make sure all issues are addressed and noted properly in the petition for dissolution of marriage. Then I hold the case and wait for the Respondent to respond. If no response, I telephone the client and ask the client to come to my office to file an Application for Default.</p>
<p>After 60 days from the date the Respondent is served, if a response is not filed, I call the client and we set the case for default on the court&#8217;s calendar. Once a default hearing is set, I prepare, the decree, the child support worksheet, and the order of assigment.</p>
<p>I then prepare the client for the default hearing with all of the necessary documents and instructions on how to answer the judges questions. Because I keep track of the deadlines and court calendars to make sure the documents are drafted according to law, my paralegal fee is $900.00 for divorces. This does not include the filing fee or process server fee.</p>
<p>Other Forms</p>
<p>The forms noted on my web site are drafted by the paralegal with my supervision. These forms costs $150.00 each, and could be less if more than one form is involved. Some forms not listed may cost more.</p>
<p>Conclusion.</p>
<p>Many clients have had to hire me to fix mistakes done by document preparers. Document prepares are not trained in the law, and are not allowed to give legal advice. So, they can not tell you how much spousal maintenance you should ask for and what is the likely-hood you could get an award for spousal maintenance. They can not tell you what to do to better your chances to obtain spousal maintenance. They can not tell you, in what circumstances, overtime pay, should be or not be considered as income to compute child support. This is why we offer in house paralegal services with attorney supervision.</p>

			<content:encoded><![CDATA[<p>Did you know that your tax return is not exempt.   That means the trustee will take all of it, unless you spend it on certain exempt items.  Such as attorneys fees, rent/mortgage payments, new car not worth over 5,000 in equity, and utilities.?  You need to know that to keep your tax return, you must file bankrutpcy after you get your tax return refund.  Keep good records of where you spend that money, or you might lose that money to the trustee.<br />
What you absolutely can NOT do is use the money to pay back close friends or family members, or give the money to friends of family members.<br />
It is important to meet with your bankruptcy attorney before you spend the money to make sure you will not have to pay it back to the trustee.</p>

<p>I practice <strong>Chapter 7 Bankruptcy in Yuma</strong>, which is called consumer bankruptcy.</p>
<p>You can literally stop harassing phone calls and nasty letters within just a few days after you file the <strong>bankruptcy</strong>. All bankruptcies are processed through the civic center the 3rd wednesday every month. The last court event is a &#8220;Creditors Meeting.&#8221; At the meeting, the Trustee will make sure you understand the information contained in your Petition for Bankruptcy, and that it accurately reflects your income and assets.</p>
<p>Once the debts are discharged, you never have to pay back the creditors. You can start with a clean slate. Under new rules you are required to enroll in a pre bankruptcy and post bankruptcy class, to help you prevent having to file a <strong>bankruptcy</strong> in the future.</p>
<p>Every debtor has to pass the means test, before they can file for a Chapter 7 Bankruptcy which is based on income and household size. Generally speaking if you earn less than $5,000.00 a month,, You will most likely pass the means test. You can earn more if you have more dependents.</p>

			<content:encoded><![CDATA[<p>Unfortunately, the U.S. Supreme Court has ruled that “Roving Border Patrols” are constitutional, even though we are not at the border. You may have been caught up with charges that are completely unrelated to citizenship.</p>
<p>As a <strong>Arizona attorney</strong>, who has been practicing <strong>criminal defense</strong> for more than 19 years, I am familiar with the standard pleas that are offered in these types of cases.</p>
<p>Yuma County has taken a no excuses policy on all of these cases, and it does not matter if you have a medical marijuana permit, or if you are a college student and this is your first offense.</p>
<p>All possession of <strong>drug paraphernalia</strong> and <strong>possession of marijuana offenses</strong> are classified as <strong>felonies</strong>. However, the border patrol agents are citing these cases as “attempted,” possession cases so they are considered misdemeanors.</p>
<p>The standard fine for every attempted drug case is $1,500.00, however, the fine in the standard plea agreement is $405.60.</p>
<p>For the most part, the standard plea agreement is to one count of attempted possession of <strong>marijuana or drug paraphernalia</strong>, and a fine. The fine is paid directly to the court and must be paid before we enter the plea agreement if you want the conviction set aside or expunged.</p>
<p>Many of my clients are worried about a criminal record, so what I can do is a set aside or what is commonly known as an expungement.</p>
<p>When you hire me, for $750.00, I will file a notice of appearance, send you the fee agreement, guilty plea proceeding aka telephonic change of plea form and set aside form. Next, I will obtain the plea agreement from the prosecutor forward it to you. Once you fill out the forms and return the originals to our office to be filed with the court, I will set up the hearing to do the change of plea and set aside over the telephone.</p>
